Version of 9 October 2026
1. Purpose
These terms of sale govern sales made on the Naopix website between Naopix (SIRET 10515958600012), 1 Square Jean Heurtin 44000, and any person making a purchase, hereinafter “the customer”. Placing an order implies full acceptance of these terms of sale.
2. Products
Naopix offers for sale:
- High-resolution digital photos: high-resolution JPEG files, without a watermark, delivered by download.
- Photo prints: physical prints made to order and shipped to the address given by the customer.
The photographs shown on the website are for illustration only and may carry a watermark, which is removed from the files purchased.
3. Prices
Prices are shown in euros, including all taxes. If the seller benefits from the VAT exemption threshold (article 293 B of the French General Tax Code), VAT is not applicable and this is stated on the invoice. Any shipping costs for prints are shown before the order is confirmed.
4. Ordering & payment
The order is confirmed after acceptance of these terms of sale and online payment. Payment is made securely via Stripe. Naopix never has access to your bank details. The order is only final once payment has been confirmed.
5. Delivery
Digital photos
Digital files are made available for download immediately after payment, from the customer area and/or via a download link. Nothing is posted for digital products.
Prints
Prints are made to order and then shipped within an estimated 5 to 10 working days to the address given by the customer.
The risk of loss of or damage to prints passes to the customer when the customer, or a third party they have designated, takes physical possession of the print (article L.216-4 of the French Consumer Code).
6. No right of withdrawal
No order placed on the Naopix website gives a right of withdrawal. The customer is informed of this before payment and expressly accepts it by ticking the box provided; this choice is restated in the confirmation email.
Digital photos
In accordance with article L.221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not supplied on a tangible medium where performance has begun with the customer’s prior express consent and express waiver of their right of withdrawal. When ordering, the customer expressly requests immediate access to their digital photos and acknowledges that they lose their right of withdrawal as soon as the photos are made available.
Prints
Prints are printed on demand, from the photo and size chosen by the customer (and, for the souvenir version, with their name, time and ranking added): they are goods made to the consumer’s specifications, excluded from the right of withdrawal by article L.221-28 3° of the French Consumer Code. Once the order has been paid, a print can therefore be neither exchanged nor refunded, unless it is faulty: a print that is defective, damaged on delivery or does not match the photo ordered is covered by the statutory guarantees below (article 7) and the procedure in article 9.
7. Statutory guarantees
Prints benefit from the statutory guarantee of conformity for goods (articles L.217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code). Digital photos benefit from the statutory guarantee of conformity for digital content (articles L.224-25-1 et seq. of the French Consumer Code). To make a claim, write to contact@naopix.me.
Prints (goods)
The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to prove the existence of the lack of conformity, not the date on which it appeared.
Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to prove the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared.
The legal guarantee of conformity obliges the trader, where applicable, to provide all updates needed to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.
If the consumer asks for the goods to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or end the contract and receive a full refund in return for giving the goods back, if:
1° The trader refuses to repair or replace the goods;
2° The goods are repaired or replaced after more than thirty days;
3° The repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;
4° The goods remain non-conforming despite the seller’s unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or to terminate the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In that case, the consumer does not have to ask for the goods to be repaired or replaced first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The rights set out above result from articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the legal guarantee of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in return for giving the goods back.
Digital photos (digital content)
The consumer has two years from the supply of the digital content or digital service to invoke the legal guarantee of conformity if a lack of conformity appears. For one year from the date of supply, the consumer only has to prove the existence of the lack of conformity, not the date on which it appeared.
The legal guarantee of conformity entails the obligation to provide all updates needed to keep the digital content or digital service in conformity.
The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following their request, free of charge and without major inconvenience to them.
The consumer may obtain a price reduction while keeping the digital content or digital service, or end the contract and receive a full refund in return for giving up the digital content or digital service, if:
1° The trader refuses to bring the digital content or digital service into conformity;
2° Bringing the digital content or digital service into conformity is unduly delayed;
3° The digital content or digital service cannot be brought into conformity without costs being imposed on the consumer;
4° Bringing the digital content or digital service into conformity causes major inconvenience to the consumer;
5° The digital content or digital service remains non-conforming despite the trader’s unsuccessful attempt to bring it into conformity.
The consumer is also entitled to a price reduction or to terminate the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In that case, the consumer does not have to ask for the digital content or digital service to be brought into conformity first.
Where the lack of conformity is minor, the consumer is only entitled to cancel the contract if the contract does not provide for payment of a price.
Any period during which the digital content or digital service is unavailable while being brought into conformity suspends the remaining guarantee period until the conforming digital content or digital service is supplied again.
The rights set out above result from articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.
A trader who obstructs the legal guarantee of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L. 242-18-1 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or digital service is kept, or to a full refund in return for giving up the digital content or digital service.
8. Intellectual property
Buying a photo gives the customer a right of personal use. Unless a specific transfer of rights has been agreed in writing, the photographs may not be resold, transferred or used for commercial purposes. Naopix retains the intellectual property in their work.
9. After-sales service
If you have a download problem or a corrupted file, contact us at contact@naopix.me: we’ll provide a new link or a new file.
Faulty or damaged print
If a print reaches you faulty (printing defect, wrong photo), damaged in transit or incomplete, write to contact@naopix.me preferably within 14 days of receiving it, giving your order number and attaching a photo of the defect (and of the packaging if it was damaged). After checking, the print is reprinted and sent again free of charge or, if reprinting is not possible, refunded. This time limit is there to handle your request quickly: it does not reduce the statutory guarantees in article 7, which you can rely on for their full duration.
10. Governing law & disputes
These terms of sale are governed by French law. In the event of a dispute, an amicable solution will be sought first before any legal action. The customer may also use a consumer mediator. Failing an amicable agreement, a consumer customer may bring proceedings, at their choice, before one of the courts with territorial jurisdiction under the French Code of Civil Procedure, or before the court of the place where they lived when the contract was concluded or when the harmful event occurred (article R.631-3 of the French Consumer Code).
